The Important Things in Roe v. Wade 1973
Roe v. Wade is a landmark 1973 case that resulted in the Supreme Court judgment on abortion rights. Jane Roe, an unmarried pregnant woman, filed a lawsuit challenging Texas abortion regulations on behalf of herself and others. A doctor from Texas joined Roe’s complaint, claiming that the state’s abortion rules were too ambiguous for physicians to follow. He’d previously been arrested for breaking the law.
Abortion was banned in Texas at the time unless it was done to save the mother’s life. Having or attempting to have an abortion was a felony.
The Supreme Court determined two critical issues in Roe v. Wade:
- The United States Constitution protects a person’s choice to choose whether or not to have an abortion as a basic “right to privacy.”
- However, the right to abortion is not absolute. It must be weighed against the government’s objectives in preserving prenatal life and health.
