Roe v. Wade (1973)
Roe v. Wade, 410 U.S. 113, was a landmark decision of the United States Supreme Court in which the Court decided that the United States Constitution usually protects a pregnant woman’s right to choose abortion. The judgment invalidated several federal and state abortion regulations, igniting an ongoing abortion debate in the United States concerning whether or not abortion should be legal, who should determine the legality of abortion, and what role moral and religious beliefs should have in the political realm. It also influenced the dispute over which procedures the Supreme Court should use in constitutional adjudication.
The lawsuit was launched by Norma McCorvey, sometimes known as “Jane Roe,” who fell pregnant with her third child in 1969. McCorvey desired an abortion, but she resided in Texas, where abortion was banned except in cases when the mother’s life was in danger. Sarah Weddington and Linda Coffee, her lawyers, filed a case in federal court on her behalf against her local district attorney, Henry Wade, contending that Texas’ abortion restrictions were unconstitutional. The applicable Texas abortion legislation was deemed illegal by a three-judge panel of the United States District Court for the Northern District of Texas. The parties filed an appeal with the Supreme Court.
