The impact of Roe v Wade
Abortion is the most controversial feminist issue. In the 1960s, there was no federal legislation governing abortions, and many states outlawed the procedure unless in emergencies.
Women’s organizations said illegality drove many women to seek abortions from unlicensed doctors or do it themselves. Consequently, California and New York legalized abortions. Without a federal verdict, women’s organizations sought the Supreme Court.
Texas banned abortions unless the mother’s life was in jeopardy. Jane Roe challenged a Texas statute, and the case reached the Supreme Court.
The Court rejected the Texas statute 7-2 after two years of hearings. The majority of the court argued, as in Griswold v. Connecticut, that the Ninth and Fourteenth Amendments entailed a right to privacy. No state may prohibit first-trimester abortions.
States might enact stringent legislation in the second trimester to protect the mother’s health. Third trimester ban: Any state statute that contradicted this judgement was overturned.
Women’s groups rejoiced. Opposition arose instantly. Catholics have historically seen abortion as infanticide. The NATIONAL RIGHT TO LIFE COMMITTEE was founded to reverse Roe v. Wade.
